Brite Terms of Service

1. Introduction

Welcome to Brite, operated by Brite Tech Inc. ("Brite," "we," "us," or "our"). By accessing or using our app and services, you agree to these Terms of Service. If you do not agree to these terms, please do not use the app.

2. Eligibility

You must be a university student over the age of 18 to use the Brite app.

3. Account Creation and Security

To use the app, you need to provide your name and university email. You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account. If you suspect any unauthorized use, please contact us immediately.

4. Use of the App

Brite grants college students a limited, non-exclusive, and revocable license to use the app for personal, non-commercial purposes. This license allows users to access and use the app as intended but does not grant any ownership rights or transfer of intellectual property.

5. Data Use and Privacy

Brite uses the collected data to enhance our services and provide valuable insights to universities. This data helps universities improve the student experience and boost retention by identifying students who may need additional support. Universities can then use this information to offer appropriate resources and assistance to help students succeed. Additionally, we use the data to inform local businesses about the performance of their promotions, including metrics such as views, ROI, and clicks, to help them gauge the effectiveness of their offers.

6. Security

At Brite, we prioritize the security of our users' data. To protect against unauthorized access, breaches, and other security threats, we implement the following standard practices:

  1. Data Encryption: All user data is encrypted both in transit using industry-standard encryption protocols. This ensures that your data remains confidential and secure.

  2. Access Controls: We use secure access controls, including strong password policies and multi-factor authentication, to safeguard user accounts and sensitive information. Only authorized personnel have access to user data based on their role and need.

  3. Secure Servers: User data is stored on secure servers hosted by reputable providers who comply with stringent security standards. We regularly update and patch our systems to protect against vulnerabilities.

  4. Monitoring and Response: Our systems are continuously monitored for suspicious activity or potential breaches. In the event of a security incident, we have established protocols for rapid response and mitigation to minimize impact.

7. Intellectual Property

Content Ownership: All intellectual property rights related to the Brite app, including its design, branding, and content, are owned by Brite Tech Inc. This includes, but is not limited to, trademarks, copyrights, and any proprietary technology used in the app.

License to Use: Brite grants college students a limited, non-exclusive, and revocable license to use the app for personal, non-commercial purposes. This license allows users to access and use the app as intended but does not grant any ownership rights or transfer of intellectual property.

User-Generated Content: Brite retains ownership of all feedback, reviews, survey responses, and other user-generated content submitted through the app. By submitting such content, users grant Brite a perpetual, royalty-free, worldwide license to use, reproduce, modify, and display this content in connection with the app and its services.

Restrictions: Users are prohibited from copying, distributing, modifying, or creating derivative works based on any content or intellectual property provided through the app. Additionally, users may not reverse-engineer, decompile, or otherwise attempt to extract the source code of the app.

8. Liability and Dispute Resolution

App Reliability: Brite strives to ensure the availability and accuracy of our app; however, we do not guarantee uninterrupted or error-free service. We may experience occasional downtime or technical issues beyond our control.

Limitation of Liability: To the fullest extent permitted by law, Brite and its affiliates are not liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to the use of our app. This includes, but is not limited to, damages related to lost rewards, data breaches, or app downtime. Our liability is limited to the maximum extent permitted by applicable law.

Notice Period: Before initiating formal dispute resolution procedures, the parties agree to provide written notice of the dispute to the other party. This notice should describe the nature of the dispute and any relevant facts. The parties will then attempt to resolve the dispute informally within 30 days of receiving the notice.

Class Action Waiver: Both parties agree that any disputes arising from or related to these Terms of Service or the use of Brite shall be resolved on an individual basis only. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration. Disputes will not be consolidated with those of other users or parties.

Governing Law: These Terms of Service and any disputes arising from or related to them shall be governed by the laws of West Virginia, without regard to its conflict of law principles.

9.  Account Termination

Termination by Brite: Brite reserves the right to terminate or suspend your access to the app, without prior notice, if you violate these Terms of Service or if we determine, in our sole discretion, that your use of the app is detrimental to the app’s operation, other users, or Brite's interests. Termination may occur in cases of misuse, unauthorized access, or failure to comply with applicable laws or regulations.

Termination by User: You may terminate your account at any time by contacting us at info@brite.company and requesting the deletion of your account. Upon termination, you will no longer have access to the app, and any accumulated rewards or points may be forfeited.

Effect of Termination: Upon termination of your account, you will lose access to the app and any associated data or content. Brite is not responsible for any loss of data or rewards resulting from account termination. Any provisions of these Terms of Service that by their nature should survive termination, including but not limited to those related to intellectual property, limitations of liability, and dispute resolution, will remain in effect.

Reinstatement: If your account is terminated for any reason, you may not be permitted to create a new account or use the app without Brite’s express permission.

10. Changes to Terms

Brite may revise these Terms of Service at any time by updating and posting the revised Terms on the app or website. Users are encouraged to visit the app or website periodically to review any changes. Significant changes will be communicated via email. Changes will be effective immediately upon posting, with the effective date being September 16th. Continued use of the app following any changes constitutes acceptance of those changes. If you do not agree with the updated Terms, you must discontinue use of the app.
