Brite Technologies LLC Privacy Policy

Effective Date: This Privacy Policy was last updated on September 15th, 2024.

This Privacy Policy (the “Policy”) discloses how information about you is collected, used, and disclosed by Brite Technologies LLC (“Brite”) when you access or otherwise visit the Brite App (the “App”), and other online products and services (collectively, the “Services”). Brite is a survey reward app where college students answer questions about their university experience and are rewarded with points redeemable for prizes provided by businesses. This survey data helps universities with student retention initiatives.

This Policy applies to information we collect when you use the Services or when you otherwise interact with us. This Policy does not apply to products or services with separate privacy policies that do not incorporate this Policy. By using the Services, you consent that you are bound by this Policy, including its applicable limitations on damages and the resolution of disputes. The Terms of Use are incorporated by reference into this Policy.

INFORMATION COLLECTION

Brite may collect information about you directly from you and from third parties, as well as automatically through your use of the Services.

Information collected directly from you:

We collect information you provide directly to us. For example, we collect information when you participate in any interactive features of the Services, fill out a form, request customer support, or otherwise communicate with us. The types of information we may collect include your name, email address, social media usernames and handles, postal address, phone number, interests, preferences, survey responses, and any other information you choose to provide. This may include personally identifiable information (“PII”).

Information collected automatically:

Brite may automatically collect the following information about your use of the App and/or Services through cookies, web beacons, and other technologies:

  • (a) your domain name;

  • (b) your browser type and operating system;

  • (c) web pages you view;

  • (d) links you click;

  • (e) your IP address;

  • (f) the length of time you visit the App; and

  • (g) the referring URL or the webpage that led you to the App.

 

INFORMATION USAGE

Brite is the sole owner of the information collected in connection with the Services. Brite will not sell, share, or rent this information to others in ways different from what is disclosed in this statement.

The information we collect from you may be used in any of the following ways:

  • To fulfill or meet the reason you provided the information. For example, if you share your name and contact information to request additional information, Brite will use that PII to respond to your inquiry.

  • To flag survey responses where students indicate a need for assistance (e.g., severe depression, food insecurity, etc. or considering dropping out of their university). In these cases, Brite will notify university administrators by providing the student's name and email, allowing the university to reach out and offer resources, etc., to assist the student and help them succeed.

  • To provide, support, personalize, and develop the Services.

  • To create, maintain, customize, and secure your account.

  • To process your requests.

  • To provide you with support and to respond to your inquiries, including to investigate and address your concerns and monitor and improve responses.

  • To help maintain the safety, security, and integrity of the Services, the App, databases, and other technology assets, and business.

  • To respond to law enforcement requests and as required by applicable law, court order, or governmental regulations.

  • As described to you when collecting your PII.

  • To evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Brite’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which PII held by Brite is among the assets transferred.

  • To administer a contest, promotion, survey, or other site feature.

  • To send periodic emails and newsletters.

  • To detect, investigate and prevent fraudulent transactions and other illegal activities and protect the rights and property of Brite and others.

  • To send you direct marketing communications and personalize these messages based on your needs and interests.

  • To collect information about your interaction (including the data described in the automatic data collection section above) with the Services, our communications, and other online services over time, and use that information to serve online ads that they think will interest you.

Note: If at any time you would like to unsubscribe from receiving future emails, we include detailed unsubscribe instructions at the bottom of each email.

 

INFORMATION PROTECTION

Security:

Brite takes reasonable precautions to protect your PII. When you submit information via the Services, Brite takes steps to protect your information both online and offline.

Although Brite endeavors to create secure and reliable Services and to safeguard against unauthorized disclosures of information, Brite cannot assure you that the PII collected will never be disclosed in a manner that is inconsistent with this Policy.

You hereby acknowledge and agree that, to the extent permissible by applicable law, Brite is not responsible for any intercepted information sent via the internet and you hereby release, to the extent permissible by applicable law, Brite from any and all claims arising out of or related to the use of any intercepted information in a manner that may violate this Policy, the law, and/or your personal privacy.

International Data:

Brite is domiciled in Morgantown, WV, USA and may use service providers that operate in other countries. Your personal information may be transferred to the United States or other locations where privacy laws may not be as protective as those in your state, province, or country.

COOKIES AND OTHER TRACKING MECHANISMS

Brite and/or third-party service providers may use cookies and other tracking mechanisms to track information about your use of the Services.

Cookies:

Cookies are alphanumeric identifiers that Brite transfers to your computer’s hard drive through your web browser for record-keeping purposes. Some cookies allow Brite to make it easier for you to navigate the Services, while others allow Brite to track your activities and use of the Services. There are two types of cookies: session and persistent cookies.

  • Session Cookies: Session cookies exist only during an online session. They disappear from your computer when you close your browser or turn off your computer. Brite may use session cookies to allow its systems to uniquely identify you during a session or while you are using the Services. This allows Brite to process your online activities as you move through the Services.

  • Persistent Cookies: Persistent cookies remain on your computer after you have closed your browser or turned off your computer. Brite may use persistent cookies to track aggregate and statistical information about user activity.

Disabling Cookies:

Most web browsers automatically accept cookies, but if you prefer, you can edit your browser options to block them in the future. The Help portion of the toolbar on most browsers will tell you how to prevent your computer from accepting new cookies, how to have the browser notify you when you receive a new cookie, or how to disable cookies altogether. Visitors to the App who disable cookies will be able to browse certain areas of the App, but some features may not function.

Clear GIFs, pixel tags, and other technologies:

Clear GIFs are tiny graphics with a unique identifier, similar in function to cookies. In contrast to cookies, which are stored on your computer’s hard drive, clear GIFs are embedded invisibly on web pages. Brite may use clear GIFs (a.k.a. web beacons, web bugs, or pixel tags), in connection with the App to, among other things, track the activities of App visitors, help Brite manage content, and compile statistics about App usage. Brite and third-party service providers may also use clear GIFs in HTML emails to clients of Brite to help Brite track email response rates, identify when emails are viewed, and track whether emails are forwarded, for example. Third-party vendors may also use pixels and tags on social media posts, ads, and chatbots to track click-through rates to the App.

Third-Party Analytics:

Brite may use automated devices and applications, such as Google Analytics and reCAPTCHA, to evaluate usage of the App and, to the extent permitted, application(s). Brite may also use other analytic means to evaluate the Services provided by the App. Brite uses these tools to help it improve the Services, performance, and user experiences. These third-party entities may use cookies and other tracking technologies to perform their services.

Do-Not-Track:

You may disable certain tracking as discussed in this section (e.g., by disabling cookies); you also may opt-out of targeted advertising by following the instructions in the Third-Party Ad Networks section below. However, the App may not recognize browser “do-not-track” requests.

Third-Party Ad Networks:

Brite may use third parties, such as network advertisers, to serve advertisements on third-party Apps or other media (e.g., social media platforms). This enables Brite and these third parties to target advertisements to you for Services offered by Brite and in which you might be interested. Third-party ad network providers, advertisers, sponsors, and/or traffic measurement services may use cookies, JavaScript, links, web beacons (including clear GIFs), Flash LSOs, and other tracking technologies to measure the effectiveness of their ads and to personalize advertising content to you. These third-party cookies and other technologies are governed by each third party’s specific privacy policy. 

Users in the United States may opt out of many third-party ad networks. For example, you may go to the Digital Advertising Alliance (“DAA”) Consumer Choice Page for information about opting out of interest-based advertising and their choices regarding having information used by DAA companies. You may also go to the Network Advertising Initiative (“NAI”) Consumer Opt-Out Page for information about opting out of interest-based advertising and their choices regarding having information used by third-party companies who are NAI members. 

Opting out from one or more companies listed on the DAA Consumer Choice Page or the NAI Consumer Opt-Out Page will remove you from those companies’ delivery of interest-based content or ads to you, but it does not mean you will no longer receive any advertising through the App or on other third-party Apps. Even if you opt out from one or more companies listed on the DAA Consumer Choice Page or the NAI Consumer Opt-Out Page, you may continue to receive advertisements, for example, based on the particular App that you are viewing (i.e., contextually based ads). Also, if your browsers are configured to reject cookies when you opt out on the DAA or NAI Apps, your opt out may not be effective. Additional

SHARING INFORMATION 

Brite may share your PII with the following parties and as otherwise described in this Privacy Policy, in other applicable notices, or at the time of collection. 

1. University Administrators
Brite may share your PII with university administrators when necessary to support student success initiatives. This may include sharing data that helps identify students who may need additional resources or assistance based on their responses within the platform. The information shared with administrators is intended to improve student retention and ensure timely support for students facing challenges.

2. Legal Compliance
Brite may disclose your PII when required by law or when we believe in good faith that such disclosure is necessary to comply with legal obligations. This includes disclosing PII to establish or defend legal claims, investigate suspected fraud or illegal activities, protect Brite’s property, or ensure the safety of clients, employees, and the public.

3. Business Transactions
In the event Brite undergoes a business transition such as a merger, acquisition, or sale of assets, your PII may be part of the assets transferred. If a business transition results in your PII being used in a manner different from what is outlined in this Policy, you will be notified via a prominent notice on our App. You will have the option to opt-out of any new use of your PII at that time.

 

THIRD PARTY LINKS 

The App may contain links to (or be hosted on) other Apps maintained by third parties. Please be aware that Brite exercises no control over linked sites or other sites and is not responsible for the privacy practices or the content of such sites. Each linked site or other site maintains its own independent privacy and data collection policies and procedures, and you are encouraged to view the privacy policies of these other sites before providing any PII and/or other information. You hereby acknowledge and agree that Brite is not responsible for the privacy practices, data collection policies and procedures, or the content of such third-party sites, and you hereby release Brite from any and all claims arising out of or related to the privacy practices, data collection policies and procedures, and/or the content of such third-party sites. 

TRANSFER OF INFORMATION TO THE US AND OTHER COUNTRIES 

Brite is based in the United States and the information we collect is governed by U.S. law. By accessing or using the Services or otherwise providing information to us, you consent to the processing, transfer and storage of information in and to the U.S. and potentially other countries, where you may not have the same rights and protections as you do under local law. 

CALIFORNIA ONLINE PRIVACY PROTECTION ACT COMPLIANCE 

While we do not believe the California Online Privacy Protection Act to be applicable to us, under California’s "Shine the Light" law, California residents who provide personal information in obtaining Services for personal, family, or household use are entitled to request and obtain from Brite, once per calendar year, information about the customer information we shared, if any, with other businesses for their own direct marketing uses. If applicable, this information would include user information and the names and addresses of those businesses with which we shared user information for the immediately prior calendar year.

To obtain this information from us, please contact Brite at info@brite.company with "Request for California Privacy Information" on the subject line and in the body of your message. We will provide the requested information to you at your email address in response. Not all information sharing is covered by the "Shine the Light'' requirements, and only covered information sharing will be included in our response. 

If you are a California resident, you have the right under California Civil Code Sections 1798.83-1798.84, to contact us to prevent disclosure of personal information to third parties for such third parties’ direct marketing purposes; in order to submit such a request, please contact Brite at info@brite.company

CHILDREN 

The Services are not intended for use by anyone under 18 years of age. If you are a parent or guardian of a child from whom you believe we have collected personal information in a manner prohibited by law, please contact us at info@brite.company. Should we learn that we have collected personal information through the Services from a child without the consent of the child’s parent or guardian as required by law, we will comply with applicable legal requirements to delete the information. 

CHANGES TO THIS POLICY 

Except to the extent limited by applicable law, Brite reserves the right to update this Policy to reflect changes to our information practices by prominently posting notice of the update on our App, and as required, obtaining your consent. Any updates will become effective immediately after posting the updates to this Policy and apply to all information collected about you, or where required, upon your consent. You agree that you will review this Policy periodically. If Brite makes any changes to this Policy, it will change the "Last Updated" date above. You are free to decide whether or not to accept a modified version of this Policy, but accepting this Policy, as modified, is required for you to continue using our App. If you do not agree to the terms of this Policy or any modified version of this Policy, your sole recourse is to terminate your use of the App and any Services offered through the App. 

If we make any changes to this Policy that materially impact previously collected information about you, we will obtain your prior express consent.
